In the case they reverse it then we are back at square 1 except we had a more progressive supreme court for a bit. I don't see how this makes our situation worse. I guess we should also give up and never bother with executive orders since they can just be undone when the Republicans get in

It's possible but there was at least an opportunity to try putting forth some moderate judges which would have a chance to pull over center Republicans or Sinema/Manchin. Or at least force the issue. I believe they also had a chance after Roe V Wade before election time in November when the political will was more there to defend the abortion issue by getting a supreme court more favorable on the issue

I hate this reasoning. They would do it anyway! They attempted a coup. You really think they would stop because there's some gentleman's agreement not to add more?

Trump and the GOP have always used these gentleman's agreements against the Democrats when they are in power and ignored them when it was their time. Obama did the same shit when he was in office not forcing through the supreme court appointee.

I agree with what you are saying I just don't think it's a problem to also say Democrats are the problem.

In a just world many GOP officials should have been thrown out of office for supporting Jan 6th and the fight to overturn the election and the supreme court should have been packed, and every day our democracy was slowly being destroyed, high up democrat officials stayed quiet instead of loudly proclaiming that the Republicans are destroying our country and democracy.

There are Democrats who don't fit into this mold but the problem is that if you ask republicans, to a man they can immediately recite the reasons to vote for trump, wall, southern border, china ... And they are dumb in falling for the lies but it's because the Republicans have been so effective at messaging and that the Democrats have failed at messaging that we are in this situation.

AOC has said she would draft up articles of impeachment for the supreme court justices involved in the decision and though she isn't a perfect politician, that's the kind of fire we need from democrats.

Regardless of all of this, in 2024 I will be voting for biden. We can't afford to give trump another chance at Kingship. Project 2025 might mean the end of US Democracy and so it is with great shame that we are all tied to the Democrats on a sinking boat.

I think the more viable option is just packing the court but biden would have to get two Republicans to flip and all Democrats to agree. It's embarrassing he didn't do it when the Democrats had Senate in 2020

Agree but I feel like pointing that out is implying this somehow doesn't make things worse which I feel like is missing the point. This removes the implicit threat of prosecution for anything the president does.

Now no matter how much political will exists for the prosecution, the president is fully and unequivocally immune.

The only reason they separated out official acts is to stall the ruling on trump's case. If it goes back to the SCOTUS they will say all acts are official but rule on the very last day they can. They are doing this to delay it until after the election.

Remember that this whole time biden could have packed the SCOTUS and turned the Republican majority into a Democrat majority. Nothing in our Constitution says only 9 supreme court appointees. He's just not willing to do it because he is a liberal and doesn't want to use his power to crush the Republicans like they need to be.

If it was trump he would have (and did) wielded the knife of political power with no hesitation but the moment Democrats have the knife they hold it with fear the Republicans would accuse them of being partisan.

Sadly probably would never happen without a lot changing. It is really hard to get one passed unless it's supported by both parties and the Republicans in the US want this (requires two thirds vote in both the House and Senate which rarely happens for any policy that's actually worth passing).

There aren't really almost any Republicans willing to do anything against Trump at this point. I guess nothing is impossible given how bad things are but
