You know I just keep comparing all this to the experience I recently went through, with a close one dying while being denied coverage by UnitedHealthcare at practically every turn. This woman spent her whole life as a nurse taking care of elderly and sick folks, but when it was her turn... where the fuck were her armed thugs making sure she got the help she needed? Oh, right, this shit-ass world doesn't work that way. The armed thugs only show up when some cash-bloated dickweeds need them to keep things shitty for the rest of us. I cannot imagine a world in which this ends in anything other than a mistrial. The state has an open and shut 2nd-degree murder case and decides to upgrade it to a 1st-degree charge, which is both much harder to pin on him and gives him a soapbox in front of the jury to explain why he did it.
There is no jury alive that would condemn him that doesn't comprise of 12 insurance executives.
They also charged 2nd degree, so even if the 1st fails he still might get convicted. Although maybe just the fact that they tried 1st could influence the jury into acquitting for 2nd as well for some reason? Who knows.

it seems like it varies drastically by what court it's in. Federal courts I think is a blanket no, state courts are more mixed, and even at the state level I've seen exceptions be made (I think derek chauvin was like this)
