Be it a really old piece of media or a new piece of media that was removed from streaming or airing for some reason. It doesn't matter what it is, all that matters is if it's no longer possible to get it legally.

Would that be considered piracy if one tried to pirate it then?

PS: OP was trying to find something that fits the latter criteria and just had to ask about if it is truly piracy.
